In Practice

Missing misconduct

The CEO of a large NFP received an anonymous report about the mishandling of an allegation of sexual exploitation. Given the relevant HR team were within scope, the CEO sought Morgain Group’s assistance in undertaking an initial review and the preparation of a suitable report for the governance group. It was determined that there was some room for improvement in complaints handling. Morgain Group worked with the executive team to enhance and develop the approach to safeguarding and related risk.

Responding to the whistleblower

Our client, the chair of a medium sized disability and aged care provider, received a whistle blower complaint regarding the capability of the executive team to monitor and ensure that relevant quality standards were being met. With a relatively new executive team and an underdeveloped quality assurance reporting regime, the board were concerned about their ability to monitor and ensure that client safety was being appropriately managed.

Working in partnership with the leadership team, Morgain Group undertook an initial assessment, provided a governance-focussed status report and recommended prioritised steps for system development and ongoing board monitoring and team reporting.

There were gaps in quality and safety systems that the board were able to prioritise and allocate resources to remediate the problems in a timely way.

Leading through conflict

A local government council were engaged in a robust deliberation regarding suitable policy steps to address community concern regarding global conflicts. The nature of the issues and strong feelings amongst councillors had led the chief executive to be concerned that obligations for psychological safety may be breached.

Morgain Group joined councillors in a facilitated conversation to consider the communication requirements of elected representatives alongside the expectations of communities, assisting the leadership group to navigate communication in complex conflict.

Some individuals in the group took advantage of a mediation option to work through specific elements of the conflict that were making reaching agreement difficult. This assisted the CEO and whole group to be confident that statutory obligations for safety and well being were being met.

The outside view

A high profile community-based organisation became aware of discussion and allegations on social media of a culture of racism and discrimination. The funding body asked the board to investigate. The board was conscious of the sensitivity and complexity to questions of culture and power. Directors wanted to be confident that the investigation addressed both the legal governance requirements and the experience of employees . They sought an independent view and assessment of the situation, to support the group, exercise effective governance and to respond to the concerns of external stakeholders.

Morgain Group provided a rapid benchmarked assessment of the context and basis of the allegations and required intervention or remediation. This was useful in supporting the executive team to handle the issue carefully and to support the governance group to have insight to the questions at play. The scoping recommendations proposed a range of cultural and system changes to establish and monitor an equitable and safe workplace.
